The magistrate’s sentencing exercise properly balanced mitigating factors (early guilty plea, first offence, remand) against aggravating public interest and deterrence; the imposed sentence of fine RM3000, default 7 days imprisonment and three strokes is proportionate and within judicial discretion and therefore the appeal is dismissed and the sentence is upheld.
