Although the JID was regularly obtained and the Plaintiff relied on compliance with procedural rules, the Defendant demonstrated an arguable defence on the merits that the post-dated cheques may be tainted by alleged illegality of the Money Lending Agreement; there was no prejudice from the modest delay and the Defendant need not establish the defence at this stage, therefore leave to defend was granted and the JID was set aside with costs in the cause.
