The Minister's decision to refer the employment dispute to the Industrial Court was ultra vires because it conflicted with and failed to give effect to Section 4 of the International Organizations (Privileges and Immunities) Act 1992 which confers immunity from suit and legal process on the Applicant; the Minister did not consider or was unable to satisfactorily rebut evidence that the Applicant's immunity had been communicated to relevant officers, therefore the decision was an error of law, taken without jurisdiction and must be quashed.
