On the evidence the court found the registered proprietor (Yeoh) was the true owner and the plaintiff was defrauded by an impostor. The Klang Land Office negligently issued a DHKK title without retrieving the manual title, failed to verify identity via available security systems, failed to follow statutory procedures and did not investigate or produce records; such conduct amounted to breach of statutory duty and negligence and could not be shielded by Section 22 NLC.
