The court held that the manufacturer's warranty and extended warranty formed binding contractual obligations between the Plaintiff and the Third Party as part of the new car delivery documents, the Plaintiff complied with the manufacturer's service schedule, and the Dealer Sales and Service Agreement imposed an indemnity/reimbursement obligation on the Third Party to the Dealer; accordingly the Third Party was liable to reimburse the Dealer and the Dealer was liable to the Plaintiff; damages and costs were awarded and interest ordered.
