On the balance of probabilities the Plaintiff failed to prove that the Defendants breached the required standard of care or that any breach materially caused her injuries; expert evidence favouring the Defendants was preferred; the treatment and post‑operative management met accepted orthopaedic practice; Defendant 1 is not vicariously liable. Consequently the claim is dismissed and costs are awarded to the Defendants.
