The Court held that the word 'father' in section 1(b), Part II, Second Schedule of the Federal Constitution means the biological father and does not include the mother except in the specific circumstance governed by section 17 Part III (illegitimate children). CTEB is binding; article 8(2) and international instruments do not displace the clear constitutional text; therefore the High Court's declaration in favor of reading 'father' to include 'mother' was erroneous and is set aside; appeal 531 allowed and appeal 273 dismissed.
