The High Court held the Sessions Court erred: the dispute over the RM820,000 tunnel form payment arose directly out of and in connection with the PAM contract and fell within clause 34.5's broad arbitration scope; therefore the requirements of s.10(1) were satisfied and a mandatory stay and referral to arbitration must be granted.
