On the facts the prosecution proved beyond reasonable doubt that the methamphetamine (7.41g) belonged to the accused collectively: chemical analysis and unbroken chain of custody linked exhibits to the raid, discovery in a bag associated with accused 1, conduct of the accused (attempted flight and struggle) and a co-accused's confession supported an inference of joint control and knowledge, invoking s34; therefore convictions under s12(2) ADB 1952 and sentencing under s39A(1) were lawful and appropriate.
