Court allowed appeal: multiple statutory procedural non-compliances were established (failure to record language on Form I implying possible non-explanation; failure to inform Secretary of service of Form I; failure to state time in recorded statement and no adequate justification for withholding statement under s14; inordinate 21-day delay by Inquiry Officer in conducting inquiry). Those defects rendered detention unlawful; High Court decision dismissing habeas corpus was set aside and writ issued for immediate release.
