The High Court upheld the Industrial Court's factual findings that the company sustained losses and legitimately closed Plant 2, that the reorganisation was bona fide and that the applicants' roles were surplus and absorbed, and therefore the employer satisfied the Soonvala criteria and s30(5) IRA 1967 so the terminations were with just cause and excuse; no error of law warranting judicial review was shown.
