The auction was a judicial sale under ss.260–265 National Land Code, no contractual relationship arose between plaintiff and chargee; plaintiff failed to prove non-attendance, misrepresentation or coercion, failed to discharge the evidential burden, the doctrine of caveat emptor applies and the proper remedy for challenging the Land Administrator's decision was an appeal under s.418 NLC; accordingly plaintiff's claims were dismissed and costs awarded to defendants.
