On the balance of probabilities the evidence (site inspection and land records) established the fallen tree was within the jurisdiction of Defendants 1-4 who owed a duty to ensure user safety and breached that duty; plaintiff did not contribute to the accident; Defendants 1-4 are 100% liable; Defendant 6 is not liable and claim against Defendant 5 withdrawn; awards: RM65,000 general damages and RM102,061.55 special damages with interest at 5% p.a. for specified periods; costs on scale.
