The Federal Court (minority) held the leave to appeal had become academic following the dissolution of the Sabah State Legislative Assembly; the Court would not exercise its residual discretion to hear the matter because any decision would have no practical effect on the parties, the criteria for the public‑interest exception were not met, and procedural prerequisites for s96 leave (decision of the Court of Appeal on the substantive questions) were lacking; therefore the preliminary objection was upheld and leave struck out.
