The Court of Appeal allowed the appeal, holding that the learned Judicial Commissioner erred by relying on extrinsic evidence (dictionary definitions and witness evidence) when the Plaintiff relied on the natural and ordinary meaning; on the correct construction the impugned passage was capable of conveying defamatory imputations that the Sultanah supported and facilitated Jho Low's advisory appointment and was involved in corrupt practices; the Defendants failed to establish justification; damages of RM300,000 were awarded jointly against the three Defendants.
