On the balance of probabilities the Plaintiff failed to prove that the complaints made to AIA were defamatory or published to the public, the complaints were bona fide communications to the proper authority protected by qualified privilege/justification and there was insufficient evidence of malice or of forgery/fraud to support the Plaintiff's claims; accordingly the Plaintiff's claim is dismissed.
