Item 8.2 of the Guidelines is intra vires the respondent's statutory powers and consistent with the LFSSR and LFSAA; the LFSSR requires approval for all Labuan leasing transactions and prescribes fees for transactions with Malaysian residents, and the LFSAA/LFSSR as the specific regulatory regime prevails over the general provision in the LCA, therefore the requirement for prior approval and fee is lawful.
