The Federal Court (majority) held that the leave questions involve grave constitutional issues concerning the extent of the TYT's discretion under the Sabah Constitution to determine loss of confidence and remove a Chief Minister; s.96(b) embraces State Constitutions; the public interest and risk of recurrence justify granting leave despite arguments of academicity; therefore leave to appeal was granted to permit full determination of those constitutional questions.
