The court held that clause 2.2 required the Plaintiffs to give written notice not later than two months before expiry and the Plaintiffs failed to do so; the clause plainly vested the licensor with an absolute discretion not to renew; there were no disputed material facts preventing an Order 14A determination; accordingly the licence was not validly renewed and expired on 30.9.2021 and summary judgment was granted for the Defendants' counterclaim for declaration, vacant possession and damages to be assessed.
