Clause 13 and the 4 December 1958 order created a life interest in favour of Tye Kean Lin with remainder to his male children; because he died leaving no male descendants the trust resulted back to the testator's estate and the plaintiff, as executrix of Tye Kean Lin, had no proprietary interest in the trust assets. Consequently the plaintiff was not entitled to the declaratory and accounting relief sought and the suit was dismissed.
