The Senior Assistant Registrar correctly exercised judicial discretion by refusing leave because the appellant failed to provide sufficient and credible reasons for an 11-year delay (no payments, no substantiated settlement negotiations, and unexplained delay in replacing solicitors), and being within the 12-year limitation period did not automatically entitle the appellant to leave; therefore the appeal is dismissed.
