The plaintiff's claim against the first defendant was struck out because the claim disclosed no reasonable cause of action (no privity of contract or pleaded basis for duty), the fraud and conspiracy allegations lacked necessary particulars and evidentiary support, and the claim was time-barred with s.29(1) inapplicable because the fraud could with reasonable diligence have been discovered; therefore the claim was plainly and obviously unsustainable under O.18 r.19 ROC 2012.
