Defendants adduced sufficient documentary and witness evidence to raise serious issues to be tried as to the existence and validity of the 16.06.2000 Sale Agreement and thus a caveatable interest; on balance of convenience the private caveat entered by Defendant 1 must be maintained until the validity of the Agreement and associated claims (including trust and limitation issues) are finally determined; Plaintiffs lack cause of action against Defendants 2–11 relating to removal of the caveat because the caveat was lodged only by Defendant 1.
