Although the plaintiff produced medical evidence of surgery and treatment, the court concluded that the cumulative prejudice to the defendants from extensive prior adjournments, long delay, death/unavailability of key witnesses, loss/incompleteness of documents and the plaintiff being the sole material witness created an injustice that could not be remedied by costs; therefore further adjournment was refused and the plaintiff's case dismissed with costs.
