On the balance of probabilities the plaintiffs discharged the burden of proof that the deceased sold the two parcels to them in 1966: contemporaneous documents in plaintiffs' possession, continuous possession and payment of taxes, absence of contemporaneous contradictory documentary evidence from the defendants, and the defendants' failure to show they exercised ownership or paid taxes led the court to accept plaintiffs' version and allow the originating application (Saman Pemula Terpinda).
