The court held the second private caveat failed at the first stage of the Luggage Distributors test because the defendants asserted only a contingent contractual expectancy arising from a conditional MBI approval which did not crystallise a present proprietary or registrable interest under Section 323 NLC; the consent judgment settled prior disputes and precludes reviving the claim by caveat, therefore the caveat must be removed.
