Additional daily fines under section 56(3) Akta 177 form part of the punishment for the same offence and do not create a new offence requiring a separate charge; a Magistrate had jurisdiction to impose the further fines by virtue of the specific provision in Akta 177 and the proviso to section 87(1) Akta 92; presence of the Deputy Public Prosecutor constituted prosecution by the Public Prosecutor so consent requirement was satisfied; accordingly the Magistrate's convictions and sentences were upheld.
