The Defendant, as registering authority and holder of records, bore the burden to prove the three statutory steps (gazette notification, presentation/registration of Form A, and memorial on register/issue document) required to convert Malay Reservation land into a Malay holding; it failed to prove registration of Form A or the requisite memorial particulars for the property, therefore the property is not a Malay holding and the Plaintiff, though a non-Malay, is entitled to be registered as proprietor and to a refund of the RM750 penalty.
