The court found the issues raised by the defendant did not constitute serious disputes of fact necessitating conversion to a writ; the principal questions involved construction and legal issues and the affidavits and exhibited documents were sufficient for determination. The defendant's alternative remedy to cross-examine the plaintiff's deponent under Order 38 r.2 was appropriate and granted. Accordingly the conversion to writ was refused and the alternative application to permit cross-examination was allowed; costs in the cause.
