Article 125 does not operate as a constitutional bar to criminal investigations or prosecutions of serving Superior Court judges; judges are not immune and need not be suspended or removed before investigation or prosecution, but investigations and prosecutions involving serving judges attract a higher standard of bona fides and must respect judicial independence, including consultation with the Chief Justice and adherence to confidentiality and non-publication protocols; abuse or investigations for collateral purposes are subject to statutory judicial review and can be set aside.
