Because prosecution had been instituted and section 56 of the Malaysian Palm Oil Board Act 1998 vests the power to order forfeiture or release of seized oil in the criminal court, decisions made in the course of criminal investigation are not amenable to judicial review absent proof of mala fides; applicants failed to prove bad faith, therefore the High Court had no power to order return and the judicial review application was dismissed.
