The Court of Appeal held the proper legal test for constructive dismissal is the contract/repudiatory test (whether there was a fundamental breach of express or implied terms) and that the Industrial Court and High Court erred by relying on reasonableness as the legal test; reasonableness may inform analysis but is not the legal test. Applying the correct principle warranted allowing the appeal.
