The Court held that Section 38(5) of the Land Acquisition Act 1960 is mandatory; the late filing of Form O without an application for enlargement of time affected the High Court's jurisdiction to hear the land reference and therefore the proceeding must be struck out.

Section 38(5) of the Land Acquisition Act 1960 is mandatory; late filing of Form O without applying for an extension under ss 38(6) and 38(7) deprived the High Court of jurisdiction to hear the land reference, therefore the proceeding must be struck out.

Mahkamah mendapati tiada pelanggaran material terhadap Peraturan 15, 16, 20, 32, 33(2) atau 53 PPLTPA/PPPA(K&T); dokumen rayuan dikemukakan dan diterima dalam masa yang munasabah, keputusan rayuan diberitahu secara bertulis ke alamat yang diberikan pemohon dan tandatangan bagi pihak Setiausaha adalah dibenarkan; tiada ketidaksahan, ketidakmunasabahan atau kesilapan prosedur yang membatalkan hukuman buang kerja; permohonan semakan kehakiman ditolak.
