Applicant failed to discharge the burden to establish a prima facie case that the Land Administrator's awards were inadequate. After evaluating common comparables and the assessors' analyses of adjustments for location, time, access, size and topography, the court accepted the assessors' conclusions and maintained the Land Administrator's awards (RM130.00 per sqm and the limited injurious affection awards already made).

The court rejected the applicant's high rate because many comparables were inappropriate (different land layers, older transactions, better locations). It accepted earlier awards in the locality as relevant comparators with adjustments and fixed the market value at RM115.00 per square metre. The court retained the 30% injurious affection award as originally made. Consequently the Administrator's award was varied to provide additional compensation of RM13,062.00 and interest at 5% p.a. from filing of Form N until full payment.

JPPHJB's valuation was set aside because it used comparables outside the proper vicinity and outside the two-year guideline, failed to account for adverse factors (proximity to funeral parlour/crematoria/cemeteries, unfavourable surroundings, sluggish market) and was supported only by reports whose author did not give oral evidence (hearsay); consequently the Court accepted the Plaintiff's Landserve valuation of MYR61,390,000 as the correct market value for stamp duty assessment.
