A 10.77% shortfall (19.07 sqm) in the stated floor area of the flat was, on the facts, a substantial misdescription; clause 11 did not apply to relieve the vendor because the misdescription was of a serious nature that considerably affected value; accordingly the vendor was not entitled to a decree of specific performance absent compensation and the plaintiffs were entitled to the declaration sought that completion could not be compelled.
