The appeal is dismissed because the plaintiff's claim is barred by res judicata — the present equitable claims arise from the same facts and subject matter as prior suits and could have been raised earlier — and, independently, the moneylending agreements are unenforceable for non‑compliance with s16 MA 1951 making the claim frivolous, vexatious and an abuse of process warranting striking out under Order 18 r 19 ROC.
