The Plaintiff's registered title was defeasible because the chain of title originated from an unlawful unlicensed moneylending transaction previously declared null and void by the High Court; accordingly the transfer to the Plaintiff could not confer indefeasible title (Nemo dat/ex turpi causa) and the originating summons for vacant possession was dismissed; court ordered restoration of title to 1st Defendant and directed payment of RM200,000 to Jainudin with interest as specified.
