The plaintiff failed to adduce prima facie evidence that the motorcycle was stolen prior to the accident beyond a police report; because a s96(3) declaration is discretionary and requires cogent prima facie proof of the alleged theft before it can be granted prior to a third party judgment, the originating summons was premature and unmeritorious; accordingly the declaration was refused and the insurer remains liable under s96(1) RTA until a valid declaration obtained before liability is incurred.
