Policy No. T0021317 was issued at 12:39:43 pm on 8.11.2022 and therefore did not cover the accident at 11:20 am the same day; the 1st Defendant failed to disclose the accident when obtaining the policy, breaching the duty of utmost good faith; the MIB Agreement does not displace the insurer's statutory right under s96(3) RTA 1987; accordingly the Plaintiff's application for a declaration that the policy is void/unenforceable in respect of that accident is allowed.
