Applying Order 59 Rules 16 and 19 ROC 2012, and having assessed complexity, skill and labour, volume and importance of documents, and significance to the parties, the Court found the plaintiff's claims substantially more complex and resource intensive than the defendant's counterclaim, assessed reasonable costs at RM250,000 for the plaintiff's original action and RM60,000 for the defendant's counterclaim, awarded each party half their respective assessed costs and ordered mutual set-off, resulting in net costs of RM95,000 payable to the plaintiff, subject to allocatur.
