The Court allowed the appeal because the respondents failed to plead with sufficient particulars or to adduce affidavit evidence of actual fraud necessary to rebut the registered title under s.340 National Land Code; the pleaded assertions of beneficial ownership and related facts did not, as pleaded, create triable issues, therefore summary judgment under Order 14 was appropriate and the High Court refusal was an appealable error.
