On the undisputed facts and authoritative guidance (including Federal Court consideration), Clauses 1, 5.8 and 6 of the Deed of Covenants are valid and enforceable: they do not contravene s24(e) Contracts Act 1950 nor Article 13 of the Federal Constitution, and s206(3) NLC permits contractual covenants to operate alongside statutory land title provisions; therefore plaintiff entitled to enforce those clauses against the first defendant.
