The Registrar lawfully entered the Registrar's Caveat pursuant to the statutory powers in the National Land Code (notably s320) to prevent fraud and facilitate investigation; the Plaintiff failed to follow the statutory cancellation/appeal route under s321(3) and s418 and misapplied s417 and res judicata against the Registrar; fraud against the Second Defendant was not established to justify cancellation or damages; accordingly the originating summons is without merit and is dismissed.
