The application was dismissed because the plaintiff did not follow the statutory procedure: he failed to apply to the Registrar for cancellation of the caveat and thereby deprived the Court of its appellate jurisdiction under s418; additionally he failed to demonstrate that the criminal charges were connected to the police report relied upon as basis for the caveat, so the caveat remains justified.
