The court dismissed the Plaintiffs' application to remove the caveat because on the facts the Defendant demonstrated a plausible caveatable interest in the land as matrimonial property (harta sepencarian) supported by evidence (draft consent letter, deposit assertions and timing) and it would be premature to penalize the Defendant for not having instituted a Syariah claim; accordingly the caveat is to be retained pending disposal of the matrimonial asset claim before the Syariah High Court.
