The Respondent's act of reducing the tenure of Lots 153 and 4026 from freehold to 99‑year leasehold upon surrender, subdivision and re‑alienation was ultra vires the National Land Code and contravened Article 13(1) of the Federal Constitution; therefore the Application is allowed and the leasehold condition is invalid, requiring reversion to freehold continuation title.
