On the balance of probabilities the court found the transfer was procured by fraud and misrepresentation based on implausible defendant testimony, contemporaneous police report by the deceased asserting he was misled, gross undervaluation shown against market/valuer evidence and lack of credible rebuttal; accordingly the defendant's registered title was defeasible under s340 of the National Land Code and transfers were set aside and the court ordered re-registration of the deceased under s417 and restitution by the plaintiffs of amounts paid, together with costs.
