The Magistrate held the claim is a contractual debt for unpaid nominee fees within the RM100,000 monetary limit and supported by appointment letter, invoice, payment receipt and admission of debt; Order 33 was unsuitable because the issues required examination of pleaded facts and evidence rather than a preliminary legal question that would dispose of the suit. Therefore the Magistrate has jurisdiction under section 90 to hear the debt claim and the defendant's Order 33 application (Lampiran 26) is dismissed.
