s.41B of the Dangerous Drugs Act is a specific statutory provision that excludes the operation of s.388 Criminal Procedure Code; an offence under s.6 read with s.39A(2) DDA is punishable with more than five years and therefore falls within s.41B(1)(b), so bail cannot be granted.
