There is no statutory mandate requiring prior leave before commencing proceedings against APLs; omission to seek leave is a procedural irregularity and not a jurisdictional nullity; the court may in the interests of justice grant leave nunc pro tunc under its inherent jurisdiction, therefore Enclosure 301 validates Enclosures 215 and 267 and the APLs' preliminary objection is dismissed.
